Scenario 1: A lifeguard was called to the locker room at the aquatic facility for a man who was apparently in cardiac arrest. The victim’s friend said he was not feeling well, was having some arm pain while getting dressed and then just collapsed. The lifeguard activated the EAP, sized up the scene, told the victim’s friend to call 9-1-1, began providing care and then left to see where the victim’s friend went.
Which legal principle could be an issue for this lifeguard? Please explain.
What would you have done differently to assist this victim?
Scenario 2: A female patron at your facility slips and falls on the deck. She hits her head, and it is bleeding slightly. You ask permission to provide care, but the patron refuses. She says she will get dressed and go home.
What should you do?
Scenario 2 continued: A few minutes after the patron enters the locker room, another patron comes out and says the woman is now unconscious in the locker room.
Although the patron initially refused care, should you help her now that she is unconscious? Why or why not?
